Welcome to Nyriz.com! These Terms of Service ("Terms") govern your access to and use of the Nyriz.com website (the "Site," "Service"), including all content, features, and functionality offered on or through the Site, and your purchase of AI-assisted nature art ("Artwork").
By accessing, Browse, or using the Service, or by clicking to accept or agree to the Terms when this option is made available to you, you (1) acknowledge that you have read, understood, and agree to be bound by these Terms; (2) represent that you are of legal age to form a binding contract with Nyriz.com; and (3) accept these Terms on behalf of yourself or the entity you represent. If you do not agree to these Terms, you must not access or use the Service.
2. Definitions
"Nyriz.com," "Nyriz," "we," "us," or "our" refers to the operating company of the Nyriz.com website.
"Service" refers to the Nyriz.com website, its content, features, functionality, and any services offered.
"User," "you," or "your" refers to the individual or entity accessing or using the Service.
"Artwork" refers to the AI-assisted nature art pieces offered for sale on the Service.
3. Use of the Service
Eligibility: You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use the Service and purchase Artwork.
Account Registration: To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account password and for any activities or actions under your account, whether or not you have authorized such activities or actions. You agree to notify us immediately of any unauthorized use of your account.

Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
Violate or encourage others to violate the rights of third parties, including intellectual property rights.
Post, upload, or distribute any content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could deem to be objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or otherwise inappropriate.
Interfere with security-related features of the Service, including by disabling or circumventing features that prevent or limit use or copying of any content.
Interfere with the operation of the Service or any user’s enjoyment of the Service, including by uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code.
Use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine," or in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents without our prior written consent.
Attempt to gain unauthorized access to the Service, user accounts, or computer systems or networks connected to the Service through hacking, password mining, or any other means.
4. Purchases and Payment
Product Descriptions: We strive to ensure that our Artwork descriptions, images, and other content are accurate and complete. However, we do not warrant that such descriptions, colors, or other content are error-free, complete, reliable, current, or accurate. The unique nature of AI-assisted art means variations can occur, and digital displays may alter perceived colors.
Pricing: All prices for Artwork are listed in [Specify Currency, e.g., USD, EUR] and are subject to change without notice. Prices do not include applicable taxes (such as sales tax, VAT) or shipping and handling charges, which will be added to your total price at checkout.
Payment: You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service. We use third-party payment processors to handle payment transactions. Your use of these third-party services is subject to their terms and conditions. We are not responsible for any errors by the payment processor.
Order Acceptance/Rejection: We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in the description or price of the Artwork, or suspicion of fraudulent activity. If we cancel an order after you have already been billed, we will issue a refund to your original payment method.
Sales Tax/VAT: You are responsible for any sales, use, duty, or other governmental taxes or fees due with respect to your purchase of Artwork.
Title and Risk of Loss: Title to and risk of loss for any Artwork purchased by you pass to you upon our delivery of the Artwork to the shipping carrier.

7. Intellectual Property Rights
Nyriz.com Content: The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, and the AI-generated Artwork conceptual designs and digital representations) are owned by Nyriz.com, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Limited License: Subject to these Terms, Nyriz.com grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use only to view and purchase Artwork.
Restrictions: You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as follows:
Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
You may store files that are automatically cached by your Web browser for display enhancement purposes.
Artwork Copyright: When you purchase an Artwork, you are purchasing the physical or digital item itself. Nyriz.com and/or its contributing artists/AI processes retain all copyright and other intellectual property rights in the Artwork. The purchase of Artwork does not grant you any right to reproduce, distribute, or create derivative works from the Artwork for commercial purposes without express written permission from Nyriz.com.
8. User Content
If you post reviews, comments, or other content ("User Content") on the Service, you grant Nyriz.com a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media. You represent and warrant that you own or otherwise control all of the rights to the User Content that you post; that the User Content is accurate; that use of the User Content you supply does not violate these Terms and will not cause injury to any person or entity; and that you will indemnify Nyriz.com for all claims resulting from User Content you supply. We have the right but not the obligation to monitor and edit or remove any User Content.
9. Disclaimers
THE SERVICE AND ALL ARTWORK AND CONTENT AVAILABLE THROUGH THE SERVICE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
NYRIZ.COM DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE SECURE, UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; OR (D) THE ACCURACY, RELIABILITY, OR CURRENCY OF ANY INFORMATION OR CONTENT PROVIDED THROUGH THE SERVICE.
WHILE WE MAKE REASONABLE EFFORTS TO DISPLAY ARTWORK ACCURATELY, WE CANNOT GUARANTEE THAT YOUR COMPUTER MONITOR'S DISPLAY OF ANY COLOR OR DETAIL WILL BE ACCURATE.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL NYRIZ.COM, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICE OR SUCH OTHER WEBSITES, OR ANY ARTWORK PURCHASED THROUGH THE SERVICE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.
IN NO EVENT SHALL NYRIZ.COM'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE OR THE AMOUNT PAID BY YOU FOR THE ARTWORK GIVING RISE TO THE CLAIM.
11. Indemnification
You agree to defend, indemnify, and hold harmless Nyriz.com, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Service.
12. Governing Law and Dispute Resolution

We reserve the right, in our sole discretion, to revise and update these Terms from time to time. All changes are effective immediately when we post them and apply to all access to and use of the Service thereafter. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.
